AI Governance in Canada: What Credit Union Directors Need to Know Now

Canada currently has no comprehensive national AI law, as the proposed Artificial Intelligence and Data Act (AIDA) died on the Order Paper when Parliament was prorogued in January 2025. While this legislative pause may appear to provide breathing room, expectations for responsible AI use continue to rise. Global frameworks like the EU AI Act, Colorado’s AI Act, and the U.S. NIST AI Risk Management Framework are already shaping market and regulatory expectations. 


For credit unions — co‑operative, member‑owned, and trust‑based institutions across Canada — strong AI governance is becoming a core part of member protection and sound oversight.


Regulators Are Paying Attention — Even Without AI‑Specific Rules


No provincial credit union regulator has published AI‑specific guidance yet. However, all have clear expectations around:

  • technology and cyber risk management

  • operational resilience

  • fair treatment of members

  • governance of automated or technology‑driven decisioning

  • oversight of third‑party vendors


In Ontario, for example:

  • FSRA’s Information Technology (IT) Risk Management guidance outlines expectations for technology governance and resilience for credit unions, which apply directly to AI systems. 

  • FSRA requires reporting of technology‑related incidents through the credit union regulatory framework, reinforcing its supervisory focus on IT risks. 

  • FSRA also publicly discloses its own AI use under Ontario’s Responsible Use of AI Directive (RUAID), signaling growing attention to AI‑supported decisioning and transparency. 


Similar themes exist across other provincial regulators, even if expressed through different frameworks.


Where Canada Is Heading


Federal consultations for Canada’s renewed national AI strategy emphasize governance, transparency, safety, fairness, and cybersecurity. The direction is clear: Canada is moving toward a governance‑heavy, risk‑based AI regulatory model.


Credit unions that take early action will be better positioned for regulatory alignment — and better able to maintain member trust.


What Credit Union Boards Should Prioritize Now


To prepare for evolving expectations, boards should ensure their credit unions:


1. Know where AI is used (AI inventory)

Identify internal, vendor-driven, and shadow AI activities.

2. Assess risks and impacts

Prioritize high‑impact or member‑facing use cases (e.g., lending, fraud detection, collections, HR screening).

3. Monitor continuously

Build processes to track drift, bias, data quality, reliability, and vulnerabilities.

4. Apply tiered governance

Increase oversight for higher‑impact systems.

5. Strengthen documentation

Maintain clear, audit‑ready evidence of governance and controls.

6. Enhance vendor due diligence

Require governance transparency and assurance artifacts from technology partners.


The Bottom Line


Canada’s legislative pause is not a governance pause. AI adoption is increasing, global expectations are accelerating, and provincial regulators are already watching how technology affects fairness, cyber resilience, and member outcomes.


Credit union directors who act now — strengthening oversight, transparency, and governance — will protect members today and ensure their organizations are ready for the regulatory frameworks of tomorrow.
